Hello KillerExe, That's some really awesome moderating on your behalf, thank you for going out of your way to check the credits, it sets a great example.

Just wanted to add, however, that when I use other people's work (especially deviantArt), I make sure I can use them, not by contacting the author however, but by checking whether it has a Copyrighted watermark stamped on it. This watermark represents that the picture is not allowed to be either downloaded or distributed in any way (copyrighted material). That is the best way to check whether a picture on DeviantArt is available for use or not. Non-watermarked also have a "Download this File" button for easy access, they generally represent work that isn't copyrighted.

Still, I appreciate your concern and respect the FPSB guidelines, so, from now on, I will try harder to confirm any copyright issues, contacting the author's wherever possible.

PS: Here is an example of watermarked (copyrighted) content, and SteelJaw's (or any other content I used from deviantart) is an example of non-watermarked content.

I have to admit that I'm not an expert concerning deviantART, which is why I really appreciate that you educated me about that. Anyway, you never know who is OK with spreading their content and who isn't. Even on deviantART there are click-whores. Some people go crazy about something like that fast and it never hurts to ask. It's morally right to do so anyway and you don't have to fear the answer. Maybe you get an authorization and maybe you don't and move on. However in some cases, I'm speaking about general stuff and not deviantART in particular, international copyright applies, which means that it doesn't matter if there is a watermark or a written license since other parts of the world have a different juristic system. In Germany for example the public is ascribed to be enlightened and intelligent. You have to expect that the up-loader is claiming the content as his/her own, which would make a copy for personal use O.K., which is why a download button is their, but not spreading the material without permission. Thus making you a criminal if you do. If the up-loader is willing to sue you and if he is patient this will be processed. It could end quickly, because the the jurisdiction of the involved parties ended, but it could get ugly just as well.

So much about the theory ... in real life almost no one cares that much about something as small as this and "cases" like this are not dealt with, because no one sues. I would still suggest you should ask for permission. Anyway, I figured you and some other readers should know the potential risks you're taking when doing something like that. ;)

Hey MetalStorm32, I contacted SteelJaw on your behalf asking for permission about this spray and I have good news. You are allowed to release this, but SteelJaw would have appreciated if you had asked first. Anyway, I just want to ask you to make sure you can do something like that in the future please. ;)

That's what I and he/she had to say:

    KillerExe_01:

    Hello there good sir/madam.

First of all this is awesome! However, I'm not really here to congratulate you on this job well done. ^^' I'm a moderator on the website gamebanana.com and I wanted to tell you that one of our users, MetalStorm32, uploaded this piece of yours as spray for the video game Counter-Strike: Source. He/she credited you and made very clear that you are the original author. A link so you can review it: [link] I just wanted to make sure that MatelStorm32 is not violating your copyright and is free to use this. Please let me know if he/she is or isn't and I'll see to that either a moderator notice will be posted mentioning that you gave an exclusive permission for this to be used or that this spray will be trashed. Thank you and I'm sorry for any trouble that could have been caused by this user of ours.

    Respectfully, KillerExe_01

    SteelJaw:

Heya! I really appreciate the comment here, and the link. Normally I would prefer to have been asked by the mod author first, but he did credit back to me and honestly, it looks pretty cool in the in-game shot. So I say let it slide, and I'll give retroactive permission for this. :>

Again, thanks! I appreciate your vigilance on your boards for artists. :>
